In short
- Monthly plans: cancel any time in Accounts and billing. You keep access until the end of the month you've paid for.
- Annual plans: cancel within 14 days of paying and we'll refund you in full, automatically. We'll email you before an annual plan renews.
- If we raise prices or change these terms in a way that's worse for you, we'll give you 30 days' notice. You can cancel and get a refund for the unused time.
- TurfSense and Larry give general advice. The product label is the legal instruction: always read and follow it.
- Your rights under the Australian Consumer Law always apply.
1. About these terms
These terms are an agreement between you and TurfSense, a registered business name (ABN 54 894 957 393), based in Queensland. In these terms, "we", "us" and "our" mean TurfSense. They apply when you use turfsense.com.au and the TurfSense app.
You agree to these terms when you create an account, or when you buy a subscription or gift voucher. Our privacy policy explains how we handle your personal information and forms part of these terms.
2. Who can use TurfSense
- You must be 18 or older.
- TurfSense is designed for lawns in Australia. Its advice is based on Australian conditions, grasses and registered products.
- Give us accurate details, and keep your sign-in secure.
- An account is for one person. Don't share your sign-in.
3. Free and paid plans
TurfSense has a free plan and paid plans. What each plan includes is set out on our pricing page at the time you buy. We keep improving TurfSense, so features will change over time.
If we remove a main feature of your paid plan, or reduce it significantly, we'll tell you. You can then cancel and get a refund for the unused time (section 6).
4. Billing, renewal and cancelling
- Prices are in Australian dollars. Payments are processed by Stripe.
- Monthly plans are charged when you subscribe and then every month.
- Annual plans are charged when you subscribe and then every year.
- Paid plans renew automatically until you cancel. Before an annual plan renews, we'll email you at least 14 days ahead with the date and the price.
- Cancel any time in Accounts and billing, under Manage subscription. Cancelling stops the next renewal. You keep your paid features until the end of the period you've paid for, and we won't charge you again. The one exception is the 14-day refund for annual plans (section 5).
- If a payment fails, Stripe will try again. If it still can't be paid, your account moves to the free plan. Your lawn data stays.
- Any discount code or special offer comes with its own conditions, which we'll show you before you pay.
- We'll email you a receipt for each payment.
5. Refunds
- Monthly plans: we don't refund part months if you change your mind.
- Annual plans: if you cancel within 14 days of paying, whether it's your first payment or a renewal, we refund the full amount automatically and your plan ends straight away. The same applies if you close your account in that time. After 14 days we don't give change-of-mind refunds, but you keep access until the end of your year.
- Changes we make: if you cancel because of a change described in section 6, we'll refund the unused part of any prepaid period.
- Your consumer rights: nothing in this section limits your rights under the Australian Consumer Law (section 11). If TurfSense has a major failure, you're entitled to cancel and get a refund for the unused portion.
6. Changes to prices or these terms
- We'll give you at least 30 days' notice by email before a price increase or a change to these terms that is worse for you.
- A price increase applies from your next renewal after the notice period.
- You can cancel before a change takes effect. If you've paid ahead and the change affects that period, we'll refund the unused part.
- For minor changes that don't reduce your rights, such as clearer wording, we'll update the date at the top.
7. Advice, AI and product labels
- General advice. TurfSense gives general information about lawn care. It's based on the details you give us, weather data and published turf research. It is not a site inspection by a qualified agronomist, and it can't take into account everything about your lawn.
- Larry is an AI. It can make mistakes, including about products and rates. Check important advice before you act on it.
- The product label is the law. Before you use any fertiliser, herbicide, fungicide, insecticide or growth regulator, read and follow its label. That covers the rate, the grasses it can be used on, the weather conditions, re-entry and withholding periods, protective equipment, storage and disposal. If TurfSense and the label ever differ, follow the label, and please tell us.
- Local rules. Check your local water restrictions and any council or state rules on chemical use.
- Take care around others. Think about children, pets, waterways and nearby plants before you apply anything.
- Products and prices. We don't sell products. Prices and availability shown in TurfSense are a guide only. The supplier is responsible for what it sells.
We take care to make our advice accurate. This section doesn't limit your rights under the Australian Consumer Law.
8. Gift vouchers
- A gift voucher gives the recipient a paid plan for 12 months.
- It must be redeemed within 3 years of purchase. The expiry date is shown on the voucher and in the voucher email.
- The 12 months starts when the voucher is redeemed, not when it's bought.
- If you already have a plan, the voucher adds to it rather than replacing it. Its 12 months come after the time you've already paid for or been given, and any billing resumes afterwards. If you'd already cancelled, your plan ends once the voucher's time runs out.
- If the voucher is for a higher plan than yours, you move up straight away, and your remaining time on your own plan follows the voucher's 12 months.
- If the voucher is for a lower plan than yours, you choose: use it on that plan, top it up to your plan by paying the difference between the two annual prices, or keep it for later.
- There are no fees to buy, hold or redeem a voucher.
- The recipient needs a TurfSense account and must be 18 or older.
- A voucher can't be exchanged for cash. It doesn't renew automatically. When it ends, the recipient chooses whether to subscribe.
- The buyer can get a full refund within 14 days of purchase if the voucher hasn't been redeemed.
- A lost voucher can be sent again from the gift vouchers page.
- Nothing in this section limits your rights under the Australian Consumer Law.
9. Your photos and content
- You own the photos, notes and other content you add to TurfSense.
- You give us permission to store and use that content to provide TurfSense to you. That includes passing it to the providers listed in our privacy policy.
- We may use combined, de-identified information to improve TurfSense. We won't use your photos for any other purpose without asking you.
- If you submit a product to the product library, you allow us to show its details to all TurfSense users.
- Lawn outlines are drawn over map imagery that a third party licenses to us. You can use your outline within TurfSense, but we can't give you any rights in the imagery.
- Only upload content you have the right to share. Don't upload photos of people without their consent.
10. Using TurfSense fairly
You must not:
- use TurfSense in a way that breaks the law
- copy, scrape or resell TurfSense or its content
- try to get around its security or reverse-engineer it
- interfere with how it works for other people
- use Larry for things unrelated to lawn and garden care, or in a way meant to overload it.
TurfSense, including its software, text, recommendations and design, belongs to us or our licensors. You may use it for your own lawn.
11. Your consumer rights and our liability
Nothing in these terms excludes, restricts or changes those rights.
Subject to those rights, and to the extent the law allows:
- we are not liable for loss caused by not following a product label, or by inaccurate information you gave us
- weather forecasts and soil temperatures come from third-party data. They are estimates and can be wrong
- TurfSense may occasionally be unavailable, for maintenance or because a provider has an outage. We'll work to restore it promptly.
12. Suspending or closing an account
- You can close your account at any time in Accounts and billing. Closing it cancels any subscription and deletes your data as set out in our privacy policy. You can download your data first. If you have paid or gifted time left, we email you a come-back code for it, valid for 3 years, so it isn't lost if you return.
- We may suspend or close an account if you seriously or repeatedly break section 10, if payment isn't made, or if the law requires it. Where it's reasonable, we'll tell you first and give you a chance to fix the problem. We won't warn you first where there's a security risk or illegal activity.
- If we close your account when you haven't broken these terms, we'll refund the unused part of any prepaid period.
- If we ever stop offering TurfSense, we'll give you at least 30 days' notice, refund the unused part of any prepaid period, and give you a chance to download your data.
13. Disputes and governing law
- If you have a problem, contact us first at customer_support@turfsense.com.au. We'll try to resolve it within 30 days.
- That doesn't stop you from contacting the Office of Fair Trading Queensland or the consumer protection agency in your state or territory, or going to a tribunal or court.
- These terms are governed by the law of Queensland. The courts of Queensland have non-exclusive jurisdiction.
- The consumer law of your own state or territory still applies to you.
